Sam’s Auto Sales Used Car Limited Warranty

Sam’s Auto Sales (“Sam’s”) provides this LIMITED WARRANTY of the ENGINE, TRANSMISSION, AND DIFFERENTIALS of the vehicle described below, subject to the following terms and conditions:

ENGINE:  Cylinder Block, cylinder heads and all internally lubricated parts.  Oil and Antifreeze leaks excluding normal seepage.

TRANSMISSION:  Case and all internally lubricated parts.  Fluid leaks excluding normal seepage. 

DIFFERENTIALS:  Front or rear differential housing and all internally lubricated parts.  Drive Shaft and universal joints.  Transfer case on four-wheel drive vehicles and all internal parts.  Oil leaks excluding normal seepage.

1.        The duration of this LIMITED WARRANTY IS forty five (45) days or 2,000 miles, whichever comes first, from the date and mileage shown below.

2.        Sam’s will pay fifty percent (50%) of parts and labor charges to repair or replace any failure of the above parts of the engine, transmission, and differentials, which occurs and is presented in the manner described below to Sam’s for repair during the term of this LIMITED WARRANTY.

3.        This LIMITED WARRANTY DOES NOT COVER any problem or failure that is caused by abuse, misuse (including, but not limited to, failure to maintain proper oil and coolant levels or continuing to operate the vehicle after warning lights or gauges indicate it should not be operated), acts of God (such as flood or weather damage), collision, vandalism or accident damage.  This warranty DOES NOT COVER any portion of the vehicle not listed above, including, but not limited to clutch, frame and body, cooling system, electrical system, fuel system, operable and inoperable accessories, brake system, steering system, suspension system, tires, wheels, or exhaust system, or any engine part this is not mentioned above, by way of example and not by way of limitation, the alternator, water pump, power steering or air conditioning components or air pump.

4.        In order to be eligible for service under this LIMITED WARRANTY, you must  return the vehicle to Sam’s for repair during the term of this warranty.  Failure to deliver your vehicle to Sam’s will void this LIMITED WARRANTY.  Sam’s will not warrant or pay for work performed by any other repair facility.

5.        This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

6.        This LIMITED WARRANTY is provided in lieu of all other warranties, express or implied, and the implied warranties of merchantability and fitness for a particular purpose are limited in duration to the term hereof.  Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.  This LIMITED WARRANTY does not cover and Sam’s expressly excludes incidental or consequential damages.  Some states do not allow the exclusion or limitation of incidental or consequential damages, so this limitation or exclusion may not apply to you.

7.        This LIMITED WARRANTY is personal to, and valid for only the purchaser (s) whose name (s) is (are) shown on this warranty. 

8.        This LIMITED WARRANTY is not valid until signed by both purchaser (s) and an authorized representative of Sam’s.
